There is no legal loophole. None.
I've actually READ the instructions on some of my games and a lot of them say in the back where the legal mumbojumbo that there is no need to make a backup of the game, and that it is illegal to do so.
Here is an example of one of said instruction manuals:

Scroll to the last page:
"Copying of any video game for any Nintendo system is illegal and is strictly prohibited by
domestic and international intellectual property laws.
“Back-up” or “archival” copies are not
authorized and are not necessary to protect your software. Violators will be prosecuted."
Now im not sure about other consoles, but i know nintendo is definitely taking steps.
