IP law, as defined by both the WIPO and the Berne Convention, makes what you're proposing - breach of contract - an actionable position
by default. In other words, you can skirt the law for just so long, until somebody decides they want your money. This isn't a subject that's open for debate or interpretation; until the concept is ruled against by member courts, what you're proposing
is illegal. Tell me, do you shoplift because your local pharmacy doesn't have a sign telling you that's illegal, too?
