I think it's even dumber to go after people who are acting stupid but are otherwise causing no problems.

As far as setting a bar, why? You can't punish people for being stupid, because then you're straying into the category of forcing people to conform to an arbitrary standard. All well and good if it's your standard, but would you want to be held to someone else's standards?
