You're joking, right? That's not a "fact" of any kind. That's total nonsense spouted by one person as a backended defense against a pending lawsuit.
Porn is still protected under copyright just like everything else out there.
I personally don't care what justifications you use to do whatever it is you do or don't do but let's not go around spouting complete nonsense.
